is it actually 24% lead crystal or lead free glass ?

The description says this is lead free, though there is a government required lead warning.

when it says the height is 12'' does that include the stopper and if not what is the height with the stopper on?

I never measured it until now. It's about 9.5" to the top with out stopper. 11" with stopper on! Hope that helps.

probably, but i have always filled from a larger 1.75 bottle, so i am not certain....

will this decanter leak if layed on it side

Yes. The stopper does not lock in place. Rather, the stopper uses only gravity and is easily lifted out of position without twisting.
