Why is it 499 not 399?

Because they'd rather you pay $499 for a $399 camera. That price is overheating my brain not just my camera.

why does the damn thing over heat so much?

Because the processor is working to pump out a huge amount of data. I bought it for diving in tropical Florida water that's 85 degrees and can't use it longer than 15 mins inside the dive case. In colder water in the 60s though it's doesn't shut off. Useless for me but fine for cooler waters. Its the most expensive paperweight I own. At $399 I wouldn't feel so mad though but at $500 this thing better work perfext longer than 15 mins in a case. Goodluck to you though I returned mine and will just use my 8 until it croaks.
