Any issues with seeing up the leg when sitting with legs crossed?

Nope, especially if you've got thicker legs. I'm wearing my shorts now and the most you can see with legs crossed is back of the mid thigh. Even when I wear the 4" inseams, you can't see anything with legs crossed.

What size for 40-42 waist?

I am a 31 inch waste and I fit a medium perfect so I estimate that you'd fit an XL! They have terrific customer service at chubbies, give em a shot! 😄😊

How dark is the navy? It looks almost black in the picture (which is what I want, since they're currently out of the the black short).
